Welcome to ELEVATE FRENCH, LLC.

Please read these Terms of Service (“Terms”) carefully and in their entirety. You must accept these terms when you visit and interact with our website found at www.elevatefrench.com (the “Website”) or establish an account to participate in our online language classes  (the “Services”). By using our Website or Services, you consent to these Terms. If you do not consent to these Terms, you may not use our Website or Services.

  1. Changes to the Terms of Use. We reserve the right to revise or modify these Terms at any time in our sole discretion without notice. All changes are effective immediately when posted. The most current version of these Terms will be posted on the Website. It is your responsibility to review these Terms periodically as they are binding on you.

  2. Description of Services. Elevate French is an online learning platform that offers online language classes (“Classes”) designed to facilitate French language learning skills in both individual and group class settings. You can sign up for classes at www.elevatefrench.com.  Most classes are conducted through Zoom and may include live video lessons, pre-recorded content, exercises, quizzes, and other educational resources. 

  3. Eligibility.  Our Website and Services are intended for use by adults aged 18 and up. By accessing or using the Website or Services, you represent and warrant that you are at least 18 years old. If you are accessing or using the Website or Services on behalf of an organization, you represent and warrant that you have the authority to bind the organization to these Terms of Use.

  4. Registration and Accounts. In order to access and use our Services, you will be required to create an account. You agree to provide accurate, complete, and up-to-date information during the registration process. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account. Access to our Services through your account are personal to you and you agree not to provide others with access to portions of this Website using your user name, password or other security information. You must notify us immediately of any unauthorized access to your account. You agree to accept responsibility for all activities that occur under your account. We reserve the right to disable any Website account in our sole discretion at any time, including if, in our opinion, you have violated any condition of these Terms.

  5. Payment Policy. Payment for Classes is required before accessing the content. Prices are listed on the Website and are subject to change. Our services are available for purchase on the Website with a user account or via telephone at  412.573.1748 without a user account. When you place an order for our Services via the Website or over the telephone, there is no legally binding agreement and Elevate French, LLC reserves the right to cancel or decline your order or any part of your order at any time until you receive email confirmation of your order placement and successful processing of payment. Email confirmation should arrive within one week. If you have not received email confirmation notice within a week, please contact us at elevatefrench@gmail.com  to verify that a class slot has been reserved and payment has gone through.  When an order consists of multiple Classes or Services, each individual Class will be treated by us as a separate offer to purchase.  Confirmation and acceptance of one offer to buy a Class shall not provide confirmation or acceptance by us of your offer to purchase any other Classes which make up your order.

  6. Cancellation Policy. Our individual Classes are subject to a 24-hour cancellation policy. We require at least 24 hours’ notice of all lesson cancellations to be eligible for rescheduling. Dates and times of rescheduled classes will be scheduled at Dr. Natalie Amgott’s availability and may not coincide with the timing of your other scheduled Classes. Group Classes are not subject to rescheduling and all group class cancellations, regardless of notice, will not be credited for a future date.

  7. Refund Policy. Our group classes are available for a refund by the date listed on the sales page. To receive the refund, the student enrolled in the class must complete the elements required as listed on the sales page. The required elements must be completed and emailed to elevatefrench@gmail.com by the date listed on the sales page in order to receive the refund.

  8. Late Policy. Our individual Classes are subject to a 15-minute late policy. If the user has not joined a scheduled class within the first 10 minutes of the scheduled start time, we will send the user an email to see if they are having trouble connecting. If we do  not receive a response and the user has not joined the class by the 15-minute mark, the class will be cancelled and non-refundable.

  9. Accessibility for Users with Disabilities. We are committed to making our Services accessible for all users. Upon request, we will provide assistance to users with disabilities and provide reasonable accommodation.  (Fees may apply). 

  10. Intellectual Property.  The content provided through our Services, including but not limited to text, images, audio and videos, is protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or create any derivative works of our content without our prior written consent. You are granted a non-exclusive, non-transferable, revocable license to access and use the Website and Class resources strictly in accordance with these Terms.

  11. Non-Professional Information. The information contained on this Website and the content of our Services and classes is designed for educational and informational purposes. All content provided by us shall not be understood or construed as legal, financial, tax, medical, health, or any other professional advice.

  12. No Guarantees. We provide the resources for our users to excel in learning the French language, but we cannot and do not guarantee individual success. Results from previous clients are not a guarantee that you will experience or obtain similar results. Learning a language is difficult and your ultimate success or failure will be the result of your own efforts, your particular situation, and other circumstances beyond our control or knowledge.

  13. User Conduct.  When using our Services and participating in our Classes, we expect you to conduct yourself in a manner that ensures a positive learning environment for all of our users. 

    • Respect for othersYou agree to treat instructors, guests and fellow participants with courtesy and respect. You will refrain from engaging in uploading, posting, transmitting, or otherwise making available unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, or otherwise objectionable content.

    • CommunicationsYou agree to engage in class discussions in a constructive and meaningful manner, and avoid spamming, sharing irrelevant content or engaging in excessive self-promotion. If you wish to provide feedback, you shall do so in a respective and constructive manner, avoiding profanity, offensive or harmful language.

    • Compliance with Laws and Regulations. You agree to not transmit illegal, harmful or fraudulent materials. You will not impersonate any person or entity or otherwise misrepresent your affiliation with a person or entity.

    • Intellectual Property and Plagiarism. You agree not to upload or share copyrighted material without prior authorization and agree to not submit other’s work as your own.

    • Privacy and Confidentiality. You agree to respect the privacy and confidentiality of other users. You will not record, screenshot, or share Class content without permission.

    • Technical and Network UseYou agree not to Interfere with or disrupt our Services or networks connected to our Services, such as introducing malware, viruses, or other harmful code. You will not attempt to gain unauthorized access to our data or systems.

13. Disclaimer of Warranties. While we strive to provide a high-quality and reliable Service, our Services are provided “as is” and without warranties of any kind, whether express or implied. We do not warrant that our Services will be uninterrupted, timely, secure, or error-free. You agree to use our Services at your own risk.

14. Limitation of Liability.  In no event shall ELEVATE FRENCH, LLC, its directors, officers, employees, or agents be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data, or other intangible losses arising out of or relating to the use of, or inability to use, the Service. Our total liability to you, whether in contract, tort (including negligence), or otherwise, shall not exceed the amount paid by you for the class in question. This limitation of liability applies to all claims, whether based on warranty, contract, tort, or any other legal theory. We will not be responsible for any losses or damages arising from temporary or permanent interruptions of the service;  any errors, inaccuracies, or omissions in content presented on our Website or in our Classes; any interactions, disputes, or conflicts that may arise between users while using our Services; nor any damages or losses that may arise from accessing or using third-party links or resources.

15. Assignment.  We may assign these Terms in whole or in part at any time without notice. You may not assign these Terms or transfer any rights to use our Website or Services.

16. Governing Law. These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions.
